The law—in this case, the Constitution—matters until a judge decides there’s a hair to be split and then it doesn’t. And no, I’m not buying this hairsplitting either.

Another day, another frivolous Donald Trump filing

For a few days now, anyone who has attempted to contact me on my Verizon number (my contact information is here) has not gotten through. Basically, I really screwed up this iPhone 15 upgrade, did everything backwards and wrong. I’ve now paid (yes, literally) for my errors (also involving the previous phone) and the problem should be resolved as I now have both the Boost Infinite and Verizon numbers on a single device.

The unexpected good news is it appears that the iPhone 15 has the ability to automatically switch to the more available network. This is something I had had to do manually in my previous adventures with dual SIM dual standby (DSDS); having it happen automatically—and smoothly—would be a real win if this actually works.

Thanks to another fuck-up, I won’t start to get a sense how well it works until tomorrow or the next day.

That said, my perception is that after a late start—I was dealing with Verizon much of the morning—I did a little better than I otherwise would. This is consistent with my experience the one day I was able to use the new phone before I ran into mobile data problems with Boost.

But it’s awfully hard to know: Retail is random; there are unknown variables, some of which I can’t even identify, let alone assign values to; and my perception is inevitably subjective and possibly affected by a desire for self-justification. It will not be possible, really, to judge from the numbers because Uber is making changes all the time too and I don’t know their impact.

Sorry, Uber, but I’m waiting for Toyota

Electric vehicles

Uber wanted to know why I haven’t gone for an electric vehicle already. Their survey was terribly crude but I was able to express concerns about range, charging time, and charging availability. More seriously, their push[1] reflects a high technology arrogance that assumes everything they do is perfect when those of us who have to use it know very well otherwise.

And, as it happens, a Wall Street Journal reporter has discovered the problem of non-working charging stations, which is yet another reason to wait. She visited charging stations in the Los Angeles basin. But there’s every reason to believe the problems she found[2] are universal.

My plan remains to wait for Toyota’s offering in this space.[3]

It’s hard to imagine the chutzpah. After Ohio voters approved a constitutional amendment guaranteeing abortion rights,[2] some state legislators thought it would be clever idea to remove adjudication of the amendment from the courts and put it in the hands of the legislature.[3]

This being the same legislature that had desperately and persistently tried to keep the amendment off the ballot and gotten its hands slapped by the state supreme court.[4] It’s one example of Republican politicians refusing the memo that the abortion issue is handing them their asses.[5]

The good news is that this particular idea is dead. The bad news is that other ideas might have a better chance of passing.[6]

As Bess Levin observes, it is more than a little bizarre that even as Republicans keep getting their asses handed to them on abortion rights, they keep pushing abortion restrictions.[1]

I’ve long suspected that Democrats prefer sitting in opposition, where they can complain about the Republicans and where no one expects them to actually accomplish anything. Now I’m forced to suspect the reverse as well.

Neoliberalism

Ideology as ‘science:’ economics

Patrick Iber has written a very smart review of Jennifer Burns’ book, Milton Friedman: The Last Conservative.[3] I do not plan on buying or recommending the book, but as is so often the case with good reviews, the review is extraordinarily useful.

Of course, you might expect me to say that. Iber largely confirms[4] much of what I’ve been saying about neoliberalism for quite some time.

But what I found especially noteworthy, is that Iber thinks circumstances and elite self-interest ensure that neoliberalism will make a comeback.[5]

Neoliberalism—the low wages, the soaring inequality, the perception that workers (especially when unionized) rather than employers are oppressors, and the fundamental unfairness—have combined to destroy my life. And the Democratic Party’s persistent embrace of neoliberalism makes a vote for their candidates an extremely difficult swallow for me.

Fig. 1. The ruins of a terminal at the Gaza airport. Image by Said Khatib (Agence France-Presse) on September 9, 2018, via the Times of Israel,[1] fair use.

I may have underestimated this: Will the hostage situation[2] be Binymanin Netanyahu’s undoing? He’s been harshly criticized for Israeli intelligence failures that enabled the Hamas attack.[3] And he’s being criticized for his conduct of the operation in Gaza,[4] which may be intentionally disproportionate,[5] and the abject absence of an end plan.[6]

I don’t see it getting any easier for him. Ehud Barak is likely correct—I suspect, if anything, he underestimates the matter—that international tolerance for Palestinian suffering is nearing an end.[7] And though the conflict is in the Gaza Strip, West Bank settlers are now on an ethnic cleansing rampage[8] while the mask has been ripped off Israel’s genocidal ambitions.[9]

Even if you support Israel and even if you consider me an anti-Semite because I condemn Israel for its treatment of Palestinians, you have to admit that the bigoted and arguably fascist pronouncements of extreme right-wing government ministers[10] make this all just a little too blatant. And if you can’t see that, you’re in for a hell of a shock, because it’s crystal clear the world most definitely does, and that whatever else the Hamas attack has accomplished, it led Israel to rip that mask off.

The nuances here are important but, it seems to me, outweighed by what seems to me an egregious error:

The Minnesota Supreme Court ruled Wednesday that former president Donald Trump can appear on the primary ballot next year but left open the possibility he could be struck from the general election ballot because of the Jan. 6, 2021, attack on the U.S. Capitol. . . .

In a short court order, Minnesota Chief Justice Natalie E. Hudson said the justices are dismissing the case because the state’s March 5 primary is “an internal party election to serve internal party purposes” that does not provide the final determination of who appears on the ballot for the general election in November 2024.

“And there is no state statute that prohibits a major political party from placing on the presidential nomination primary ballot, or sending delegates to the national convention supporting, a candidate who is ineligible to hold office,” Hudson wrote.[2]

The entire point of a primary election is to determine who will appear on the ballot in the general election. To say this “does not proved the final determination” seems simultaneously absurd and to entirely miss the point.
